Terms of sale

Article 1 - Collector's products
Seeds, plants, dried plant material, roots, resins and incense sold on this website are sold exclusively as ornamental, growing and botanical collection products. They are not intended for human or animal consumption. The customer undertakes not to consume them or use them for medical purposes, and declares that they are of legal age.

Article 2 - Food products
Some products in the catalogue are, however, foodstuffs and are identified as such on their product page: teas, herbal infusions, aromatic and edible plants, fruit and spirit drinks. They are to be consumed under the conditions stated on their product page and label.

Article 3 - Alcoholic drinks and legal age
The sale of alcoholic drinks to persons under 18 is prohibited, in accordance with article L3342-1 of the French Public Health Code. By ordering a product containing alcohol, the customer declares that they are of legal age. Alcohol abuse is dangerous for your health. Please drink responsibly.

Article 4 - Compliance with the law
All products sold on this website comply with French law.

Article 5 - Traditional uses
The interest SAS Le Jardin ethnobotanique takes in the traditional uses of plants is documentary and cultural. It must in no way be interpreted as an incentive to consume them. No dosage, preparation method or expected effect is given.

Article 6 - Customer's responsibility
The customer is fully responsible for any use or misuse of the products ordered from SAS Le Jardin ethnobotanique. The customer accepts responsibility for the use made of the plants and seeds purchased.

Article 7 - Payment methods
Payment is made when ordering, by bank card (Visa, Mastercard, American Express), Shop Pay, Apple Pay, bank transfer or cryptocurrency, depending on the options shown at checkout. Cheques and cash money orders are not accepted.

Article 8 - Orders paid by bank transfer
The order is prepared once the funds have been received. If no transfer is received within 7 days, and after a reminder e-mail, the order may be cancelled.

Article 9 - Delivery times
Preparation: 3 to 7 working days. Transit: 2 to 5 working days in France, 5 to 11 working days outside France. These times exclude out-of-stock products and live plants (article 10). Unless another date has been agreed, delivery takes place no later than 30 days after the order (article L216-1 of the French Consumer Code).

Article 10 - Live plants
Live plants are shipped from April to the end of October, early in the week, and cannot be ordered from November to March. They are delivered to mainland France only, with a European plant passport.

Article 11 - Out-of-stock products
An order is shipped in a single parcel. If a product you ordered is out of stock, we let you know by e-mail with the expected restocking time, and you choose: wait for the product, receive a voucher for the same amount, or be refunded for that product. The refund is made no later than 14 days after your request, using the payment method used for the order, or by bank transfer if that method does not allow it.

Article 12 - Shipping days
Products are shipped every day of the week except Fridays, weekends, public holidays and holiday periods. Plants are the exception: they are shipped only early in the week.

Article 13 - Plant packaging
Plants are shipped in a cardboard sleeve that protects the foliage, inside a box filled with paper or padding so that they cannot move.

Article 14 - Acceptance of the terms of sale
The customer is bound by these terms of sale, which must be accepted when placing an order.

Article 15 - Right of withdrawal and returns
Under article L221-18 of the French Consumer Code, you have a 14-day right of withdrawal from the day you receive your order, without having to give a reason. To exercise it, send us the form below or any unambiguous statement at contact@legba.fr.
In accordance with article L221-28, this right does not apply to live plants, which are liable to deteriorate rapidly, or to foodstuffs and seed packets unsealed after delivery. Return costs are paid by the customer, unless the item is defective or we made an error. Items can be returned by post or dropped off at the greenhouse by appointment, no later than 14 days after you informed us of your decision to withdraw (article L221-23). The refund is made within 14 days, using the payment method used for the order, and may be withheld until we receive the products or proof that they have been sent back (article L221-24). If you withdraw from the whole order, it includes the original delivery costs, based on the standard rate.

Article 16 - Legal guarantee of conformity
Independently of any commercial guarantee, the customer benefits from the legal guarantee of conformity provided for in articles L217-3 et seq. of the French Consumer Code, and from the guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code. The legal guarantee of conformity applies for two years from delivery of the goods.

Article 17 - Data passed on to the carrier
To deliver your order, we pass on to the carrier you chose, Colissimo (La Poste) or Mondial Relay, your first name, last name, delivery address and, if needed, e-mail address and telephone number. This transfer is necessary for the performance of the contract (article 6.1.b of the GDPR). Details are given in our privacy policy.

Article 18 - Damaged parcels or plants
If a plant or product arrives damaged, take photos on receipt and write to us at contact@legba.fr: they help us handle your request and claim on the carrier's insurance. Depending on the condition, we will offer advice to save the plant, a replacement or a refund. These offers are in addition to your rights under the legal guarantee of conformity (article 16) and do not limit them.

Article 19 - Photographs
Photos shown on the website are examples. The size and shape of the products shipped may vary, particularly for plants and some dried products.

Protection of personal data
The data needed for your order is processed by SAS Le Jardin ethnobotanique and passed on only to the service providers who need it to fulfil the order: shop hosting and payment (Shopify and the provider of the payment method you choose), delivery (article 17) and, if you leave a review, the customer review platform. It is never sold. In accordance with the General Data Protection Regulation and French law no. 78-17 of 6 January 1978, you can access your data, have it corrected or erased by writing to contact@legba.fr, and lodge a complaint with the CNIL.
